These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Lufkin.
REQUEST FOR USE OF FUNDS
On or about July 26, 2022 the City of Lufkin will begin to undertake a set of projects known as ARPA Water and Sewer System Improvements for the purpose of providing necessary water and sewer system improvements with funding from the U.S. Department of the Treasury under the American Rescue Plan Act of 2021 (ARPA) Coronavirus Local Fiscal Recovery Fund (CLFRF), TX0979. Projects include: backup power generator and electrical improvements at the Wastewater Treatment Plant located on FM Highway 324 South, Lufkin, Texas (N 31.286415°, W -94.749591°); relocation of the Hurricane Creek 42-inch sewer main located south of Park Drive, West of FM Highway 819, Lufkin, Texas (N 31.292989°, W -94.739330°); electrical and building improvements at Water Plant Nos. 1 & 2 and improvements to existing ground storage tanks Nos. 3 & 4, located at the north end of MLK Jr. Boulevard, Lufkin Texas (N 31.376935°, W -94.725174°); install standby power generator at Water Well No. 10 located on the north side of FM Highway 2021, Lufkin, Texas (N 31.410184°, W -94.754004°); install standby power generator at Water Well No. 34 located on the south side of FM Highway 843, Lufkin, Texas (N 31.434710°, W -94.735689°); rehabilitate the Whitehouse elevated water storage tank located at 408 Whitehouse Drive, Lufkin, Texas, (N 31.297673, W -94.719675); and purchase of trailer mounted generators. These projects include administration, engineering, environmental, acquisition, and construction activities.
FINDING OF NO SIGNIFICANT IMPACT
The City of Lufkin has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at City Hall, Engineering Department, 300 E. Shepherd Avenue, Lufkin, TX 75902-3252 where ERR can be examined and may be examined or copied weekdays 8:00 A.M to 12:00 P.M. and 1:00 P.M. to 5:00 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the City of Lufkin, Engineering Department, 300 E. Shepherd Avenue, Lufkin, TX 75902-3252. All comments received by July 25, 2022 will be considered by the City of Lufkin prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
The City of Lufkin certifies that Kevin Gee, P.E. in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.
OBJECTIONS TO USE OF FUNDS
The City of Lufkin will accept objections to its use of funds during the comment period only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Lufkin; (b) the City of Lufkin has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a use of funds by City of Lufkin; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Mr. Kevin Gee, P.E., City Manager, City of Lufkin, 300 E. Shepherd Avenue, Lufkin, TX 75902-3252.
